We will not use your personal information for materially different, unrelated, or incompatible purposes without providing you notice and, where required, obtaining your consent.
If You Are Located in the EU or UK
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases:

- Support our marketing activities.
- Understand how our users use our products and services so we can improve user experience.

- If we have reasonable grounds to believe an individual has been, is, or may be a victim of financial abuse.
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information, and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced.
- If the collection is solely for journalistic, artistic, or literary purposes.

8. Is Your Information Transferred Internationally?
In Short: We may transfer, store, and process your information in countries other than your own.
Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "When and With Whom Do We Share Your Personal Information?" above), in the United States, and other countries. Some of these jurisdictions may have data protection laws that differ from those in your home country, and in some cases may not be considered to provide “adequate” protection under applicable privacy laws.
If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law. Where required, we will conduct transfer impact assessments to evaluate whether the transferred data retains a level of protection that is essentially equivalent to that guaranteed within the EEA, UK, or Switzerland.
European Commission's Standard Contractual Clauses
We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.
Where applicable for UK users, we may also rely on the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses. For Swiss users, we apply the Swiss-specific modifications to the SCCs as required by the Swiss Federal Act on Data Protection (FADP).
In limited circumstances, we may rely on statutory derogations (such as your explicit consent or the necessity of the transfer for the performance of a contract) when no other safeguard is available.
You may contact us at any time to obtain information about the specific safeguards we use for international transfers or to request a copy of the relevant transfer mechanism.
9. How Long Do We Keep Your Information?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us. Where applicable, we maintain internal retention schedules that define how long different categories of personal information are stored, based on the nature of the information, the risks associated with retention, and our legal or contractual obligations.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. We may retain anonymized or aggregated data that does not identify you for analytics, product improvement, training of our models, or other legitimate business purposes.
If you request deletion of your account or personal information, we will follow our established deletion procedures and will delete or anonymize your personal information within the timelines required by applicable law. Certain information may be retained for fraud detection, security, enforcing our rights, or complying with legal obligations.
We may also retain records of consents, withdrawals of consent, privacy requests, and our responses as required by data protection laws.
10. How Do We Keep Your Information Safe?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. These measures include access controls, encryption in transit and at rest where appropriate, monitoring for unauthorized access, regular security assessments, vulnerability management, and strict limitations on who within our organization may access personal information. We also require our service providers and processors to implement appropriate security controls to safeguard personal information that they handle on our behalf. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.
Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment. If we become aware of a data breach that affects your personal information, we will notify you and any applicable regulators as required by law.

If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at contact@opendrawing.ai.
12. What Are Your Privacy Rights?
In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

- To request rectification or erasure.
- To restrict the processing of your personal information.

In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "How Can You Contact Us About This Notice?" below.
Withdrawing Your Consent
If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "How Can You Contact Us About This Notice?" below. Withdrawal will not affect the lawfulness of processing that occurred prior to the withdrawal.
Opting Out of Marketing and Promotional Communications
You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section "How Can You Contact Us About This Notice?" below. You will then be removed from the marketing lists. However, we may still communicate with you - for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

If you would like to review or change the information in your account or terminate your account, you can:
- Log in to your account settings and update your user account.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms, and/or comply with applicable legal requirements.

13. California Privacy Law
This section applies exclusively to individuals who reside in the State of California and supplements all other disclosures contained in this Privacy Notice. It is provided in accordance with the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA) (collectively, “California Privacy Law”).
If you are a California resident, you have specific rights regarding your personal information. These include the right to know and access the categories and specific pieces of personal information we have collected, the sources from which the information was obtained, the purposes for which it is used, and the categories of third parties with whom it has been shared or disclosed. You also have the right to request deletion of your personal information, the right to request correction of inaccurate information that we maintain about you, and the right to obtain a copy of personal information that you previously provided to us. You further have the right to opt out of any activity that may be considered a “sale” or “sharing” of personal information under California law, which includes certain analytics, cross-device tracking, and interest-based advertising technologies. You may exercise this right at any time by submitting an opt-out request or by enabling a browser-based Global Privacy Control (GPC) signal, which we recognize as a valid opt-out request for that browser. You also have the right to limit our use of any “sensitive personal information” should we ever process such information; however, we do not presently collect or process sensitive personal information as defined under the CPRA. Finally, California residents have the right to be free from discrimination for exercising their privacy rights and the right to appeal any decision in which we decline to take action on a request.
We may collect categories of personal information that include identifiers (such as your name, email address, IP address, or account information), customer records information (such as billing details), commercial information (such as your transaction or subscription history), internet or network activity information (such as device identifiers and interactions with our website), geolocation data derived from IP addresses, and user-generated content, including images or other content you choose to upload. We do not collect categories of information that qualify as sensitive personal information under California law. We may disclose these categories of information to service providers for operational purposes such as payment processing, analytics, customer support, security, website functionality, advertising measurement, or delivering features of the Services. We do not disclose personal information to third parties in exchange for monetary consideration.
California residents may submit a privacy rights request by contacting us at contact@opendrawing.ai. To protect your personal information, we may require verified proof of identity before processing your request, and in cases where we cannot verify identity, we may be unable to fulfill the request. You may also designate an authorized agent to submit a request on your behalf, provided that the agent supplies written permission and we can verify your identity and relationship to the agent. If we deny your request under an applicable exception, you have the right to appeal our decision by contacting us through the same email address; if your appeal is denied, you may submit a complaint to the California Attorney General.
California law also requires disclosure of our practices related to browser-based Do Not Track (DNT) signals. Because there is currently no established industry standard for responding to DNT signals, we do not respond to them. However, as required under California law, we do honor Global Privacy Control (GPC) signals as a valid request to opt out of the sale or sharing of personal information.
We retain personal information consistent with the retention practices described in the “How Long Do We Keep Your Information?” section above.
14. Colorado, Virginia, Connecticut, Utah Laws
This section applies to residents of Colorado, Virginia, Connecticut, and Utah and supplements the rest of this Privacy Notice. These states have enacted comprehensive data privacy laws that grant consumers certain rights regarding their personal information. If you reside in one of these states, you have the right to confirm whether we process your personal information, the right to access and obtain a copy of such information, and the right to request that we delete personal information we have collected from you, subject to applicable legal exceptions. You also have the right to request that we correct any inaccuracies in the personal information we maintain about you, taking into account the nature of the data and the purposes for which it is processed. In addition, you may request a portable copy of the personal information you have previously provided to us in a usable format to the extent required by law.
These state laws also grant consumers the right to opt out of certain types of data processing. This includes the right to opt out of the processing of personal information for purposes of targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects. We may use certain analytics or advertising technologies that could be considered “targeted advertising” under these laws, and you may opt out at any time by contacting us at contact@opendrawing.ai or by utilizing any available opt-out mechanisms provided within our Services. Where required by applicable law, we will also process recognized universal opt-out preference signals, such as the Global Privacy Control (GPC), as a valid request to opt out of targeted advertising.
If you submit a rights request under this section, we may require sufficient information to verify your identity before we can process your request. If we decline to act on a request, you have the right to appeal our decision, and instructions for exercising this right will be provided in our response. If your appeal is denied, you may contact your state attorney general for further review. We do not process sensitive personal information in a way that requires offering additional consumer rights under these state laws, and we do not knowingly collect personal information from children. We retain personal information in accordance with the retention practices described elsewhere in this Privacy Notice.
Controls for Do-Not-Track Features
In Short: Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.
At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
14. Automated Decision Making
We do not currently use automated decision making that produces legal effects or similarly significant impacts on individual users without human involvement. Automated decision making refers to decisions made solely through algorithmic or technological processes, including artificial intelligence or machine learning systems, without any meaningful human review. Although certain features of our Services rely on automated processing to support performance, enhance functionality, analyze usage, or generate content, these processes are designed to improve user experience and operational efficiency and are not used to evaluate, profile, or make determinations that materially affect your rights or access to the Services.
Our AI-powered tools may analyze or generate images, user inputs, or other outputs as part of the Services. These activities are limited to functional processing and do not result in any form of automated decision that affects your legal rights. All such processing is carried out in accordance with this Privacy Notice and applicable contractual or regulatory obligations.
If we implement automated decision making in the future in a manner that could significantly affect you, we will update this Privacy Notice to describe the logic involved, the expected impact, and the rights available to you under applicable law. Where required, we will also obtain your consent and provide options to request human review or to opt out.
15. Third-Party Services
Our Services may integrate with or provide access to third-party websites, applications, platforms, APIs, or services that operate independently from us. These third-party services have their own terms, conditions, and privacy practices, and we are not responsible for their content, policies, or security practices. Your interactions with any third-party service are governed solely by your relationship with that provider, even when the service is accessed through our platform.
When you choose to use a third-party service, such as a social media login provider, analytics service, payment processor, or cloud hosting partner, any personal information you share with that third party is subject to its own privacy notice. We encourage you to review the privacy policies of any third-party services you engage with to understand how your information is collected, processed, and protected.
Although we may use third parties to support essential operational tasks such as hosting, data storage, analytics, payment processing, and AI infrastructure, we require these providers to maintain appropriate safeguards that meet applicable legal and industry standards. However, we cannot guarantee or control the independent privacy or security practices of third-party providers.
Your use of third-party services is voluntary, and any risks arising from your use of such services are your own. We disclaim responsibility for any damages or issues resulting from third-party services not operated or controlled by us.
16. International Transfers
We may transfer, store, and process your personal information in countries other than your country of residence. Our primary servers and business operations are located in the United States, and when you access or use the Services from outside the United States, your information may be transferred to and maintained on servers located in the United States or in other jurisdictions where our service providers operate. These jurisdictions may have data protection laws that differ from those in your home country and may not provide the same level of protection.
When required by applicable law, we implement appropriate safeguards to ensure that any international transfer of personal information is conducted in a lawful and secure manner. These safeguards may include reliance on Standard Contractual Clauses approved by relevant regulatory authorities, verified contractual commitments by service providers to maintain adequate privacy and security protections, or other legally recognized transfer mechanisms. Additional details regarding these safeguards can be provided upon request.
By using the Services, you acknowledge that your information may be transferred to and processed in jurisdictions that may not offer the same protections as your country of residence. You further consent to such transfers to the extent permitted by applicable law. We will continue to monitor developments in international data protection requirements and will update our practices and this Privacy Notice as necessary to maintain compliance.
17. Children’s Privacy
We do not knowingly collect, solicit, or process personal information from children under the age of 18, and the Services are not directed to individuals under this age threshold. By using the Services, you represent that you are at least 18 years old or that you are the parent or legal guardian of a minor who is at least 18 years old and who is authorized to use the Services under your supervision. If we become aware that personal information has been collected from a child under the age of 18, we will take reasonable steps to promptly delete that information and terminate any associated accounts.
If you believe that a child under the age of 18 may have provided personal information to us, please contact us at contact@opendrawing.ai so that we can investigate and take appropriate action. We encourage parents and guardians to supervise their children’s use of online services and to teach them about the responsible handling of personal information
18. Data Breach
We take the security of your personal information seriously and maintain administrative, technical, and physical safeguards designed to protect it from unauthorized access, disclosure, alteration, or destruction. Despite these efforts, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a data breach that involves the unauthorized access to or acquisition of personal information, we will investigate the incident promptly and take all steps required by applicable law. This may include notifying affected individuals, regulatory authorities, and other parties as required. The timing and method of such notifications will be made in accordance with relevant legal requirements and may vary depending on the nature of the breach and the jurisdictions involved.
In the event of a breach, we may also take additional measures to mitigate potential harm, including resetting passwords, enhancing our security protocols, cooperating with law enforcement authorities, and providing information and guidance to affected individuals on how they can protect themselves from potential misuse of their information.
If you suspect that your personal information has been compromised while using the Services, please contact us immediately at contact@opendrawing.ai so that we can review the matter and take appropriate action.
